Requiring food delivery companies to be responsible for the safe operation of electric food delivery bicycles.
This bill would require third-party food delivery services to be responsible for ensuring that food delivery workers using electric food delivery bicycles to make deliveries on their behalf, operate such bicycles in accordance with sections 19-176 and 19-195.1, which concern the operation of bicycles on sidewalks and at intersections. This bill would require third-party food delivery services to accept financial liability for civil penalties resulting from a food delivery worker’s violation of section 19-176 or 19-195.1, while engaged in the pick-up and delivery of food and/or beverage items. This bill also requires food delivery workers to notify the third-party food delivery service for whom they were working at the time of the violation within 10 days from the issuance of any fine and provides an affirmative defense to any civil penalty for third-party food delivery services who were not properly notified of a violation by a food delivery worker.
