A Local Law to amend the administrative code of the city of New York, in relation to notices of violation issued by the department of transportation for sidewalks enrolled in the department of parks and recreation’s trees and sidewalks program
This bill would require that the Department of Parks and Recreation (“DPR”) indicate which segment of sidewalk, known as a sidewalk flag, it intends to repair as part of its Trees and Sidewalks Program (“TSP”). DPR will also be required to provide notice to the homeowner whose property abuts the sidewalk in question which sidewalk flag it intends to repair. DPR and the Department of Transportation (“DOT”) would be required to maintain a database of planned sidewalk repairs. DOT would be required to verify whether a sidewalk flag is enrolled in the TSP before issuing a notice of violation. This bill would also make enrollment in the TSP a defense against any charges issued to a homeowner for sidewalk repair before the bill’s effective date. This bill would be retroactive to the commencement of the TSP, March 1, 2005.
