A Local Law to amend the administrative code of the city of New York, in relation to the creation of a remediation of unsafe flooded homes program
This bill would create a Remediation of Unsafe Flooded Homes Program. Under this program, the Department of Housing Preservation and Development (HPD) would consult with the Department of Buildings (DOB) to identify and inspect 1-2 family homes that experienced flooding during Hurricane Sandy. Only homes that display (1) externally visible unsafe conditions, or (2) evidence that the home has been abandoned or vacant since Hurricane Sandy coupled with evidence that the home has been unremediated since the storm, would be inspected. The bill gives Council Members and Borough Presidents the authority to add homes to the program if they meet this criteria. HPD and DOB would order the correction of any violations and, if economically infeasible for an owner to correct them, may order a home be vacated, removed, demolished or may acquire the property using the power of eminent domain.
