A Local Law to amend the administrative code of the city of New York, in relation to penalties for construction site safety violations that result in or are accompanied by death or serious physical injury

This bill would allow the city to recover penalties of up to $500,000 for companies and $150,000 for individuals for a violation of the site safety provisions of the construction code, where the violation is accompanied by death or serious physical injury. In determining the amount of the civil penalty, the court must consider several factors, including the extent and severity of the injury, history of violations, degree of willfulness or negligence displayed by the defendant, and the defendant’s financial resources.
