Concrete Bills

Requiring consumers to affirmatively consent to continue being charged at least once a year in any contract containing automatic payments that lasts more than one year.

A Local Law to amend the administrative code of the city of New York, in relation to requiring consumers to affirmatively consent to continue being charged at least once a year in any contract containing automatic payments that lasts more than one year

This bill would require any seller in a consumer contract that has automatic payments occurring periodically to receive affirmative consent that the buyer wishes to continue the contract. Buyers must give such consent at least once a year or the seller must stop charging for the service. The bill would prevent subscription-based businesses from profiting indefinitely off of consumers who may be unaware of the continuing charges. The bill would provide both administrative and private remedies.
